01Agreement to these terms
These Terms & Conditions are a binding agreement between you and Kimevik covering the KimeGem mobile app, website, and API (the “Service”). By creating an account or using the Service you accept them. If you do not accept them, do not use the Service.
You must be at least 18 and legally able to enter into a contract. If you use the Service on behalf of a business, you confirm you are authorised to bind it.
02What the Service is
KimeGem is a community registry that detects when the same diamond grading report number is registered by more than one person, and alerts the parties involved. Registration and duplicate-claim alerts are provided free of charge.
The Service checks a report number against the issuing grading laboratory’s own public lookup, and lets you raise a trust tier by submitting camera evidence for review.
03What the Service is not — read this section
We are not a grading laboratory. We never see, test, weigh, measure, or grade your stone. We express no opinion on whether a diamond is genuine, natural, lab-grown, treated, or correctly graded.
We are not an appraiser or a valuer. Nothing in the Service is a valuation, and nothing in it should be relied on for insurance, taxation, lending, probate, or resale pricing.
We are not an arbiter of ownership. A trust tier is a measure of how much evidence has been submitted and reviewed. It is not a determination of legal title, and it does not decide who owns a stone. Only a court can do that.
We are not an escrow service, insurer, marketplace, dealer, broker, or law-enforcement body, and we do not provide legal, financial, or investment advice.
An absence of conflict proves nothing. If no duplicate claim appears, that means only that no duplicate claim has been registered with us. It does not mean the stone is genuine, that the seller is honest, or that the certificate is real.
A clear result is a snapshot, not a promise about the future. A check reflects only what has been registered at the moment you run it. A report number with no duplicate today can show one next week, when another buyer or owner registers the same number. We do not tell you that a stone is safe to buy, and we do not claim that a number which looks clear now will stay that way. Check again immediately before you commit to a purchase, and register your own entry so that you are alerted if a competing claim appears later.
A conflict proves nothing either. A duplicate claim is a signal to investigate, not a finding of fraud, theft, or wrongdoing against anyone. Treat it as a reason to ask questions of the seller, marketplace, insurer, or laboratory — and, where appropriate, the police.
We do not investigate or adjudicate disputes. When two claims collide, we do not determine which party is telling the truth, whether either party’s evidence is genuine, or who actually owns the stone. We show both sides that a collision exists and how strong each side’s evidence is; resolving it is between the parties, and where appropriate, the marketplace, insurer, grading laboratory, or police.
04Verification, review, and accuracy
We target 24 hours for laboratory verification but do not guarantee any timeframe. Grading laboratories operate their own systems, may rate-limit or block automated lookups, and may change or withdraw them without notice.
Evidence review is carried out by human reviewers exercising reasonable judgement on the material submitted. Review is not forensic document examination: a reviewer checks that an image plausibly shows the right report number and a real card, invoice, or stone — not whether that image is an original, whether it has been submitted by someone else claiming the same number, or whether it is the only genuine copy in existence. A reviewer may approve, reject, or ask for a fresh submission, and may block a submission that appears fraudulent or abusive, but a review decision is not a finding of fact about authenticity.
Verification results, trust tiers, conflict signals, and community counters are provided on an as-is basis and may be incomplete, delayed, or wrong.
05Protecting your own evidence
The Service can only compare what it is shown. If a photograph of your grading card, invoice, or the stone itself becomes available to someone else — through a marketplace listing, a shared drive, social media, a repair or valuation visit, or any other route outside the Service — nothing stops that person from submitting the same or a similar image against the same report number.
Keep photographs of your grading card and ownership documents private, and share them only where you have to. This is a precaution we recommend, not a guarantee: the Service, and camera-only capture in particular, raise the effort required to pass off evidence that was never in your hands, but neither can eliminate it.
If a duplicate claim does reach the same trust tier as yours, we cannot tell you which of you is right. What we can do is what section “What the Service is not” above already says: show the signal, not decide the outcome.
06Your account
You sign in through Google or Apple. You are responsible for keeping access to that account secure and for everything done through your KimeGem account. Tell us promptly at support-kimegem@kimevik.com if you believe it has been compromised, and sign out to revoke your session.
One account per person. Do not share credentials or let another person use your account.
07Your content and the promises you make about it
You keep ownership of everything you submit. You grant us a limited, worldwide, royalty-free licence to store, process, and display that content strictly in order to operate the Service — verifying entries, matching claims, reviewing evidence, and showing it back to you. That licence ends when you delete the content, except for backups and audit records held for the periods described in the Privacy Policy.
You confirm that: you have the right to submit what you submit; the report number you register relates to a stone you own, are genuinely buying, or are lawfully checking; photographs are of documents and items actually in your possession, taken by you; and nothing you submit infringes anyone’s rights or breaches any law.
Submitting deliberately false evidence, or registering a number in order to interfere with a legitimate owner, is a serious misuse of the Service and grounds for immediate termination and referral to the relevant authorities.
08Acceptable use
You must not: attempt to identify another user from a conflict signal; use the Service to harass, threaten, defame, extort, or intimidate anyone; scrape, bulk-register, enumerate, or otherwise try to reconstruct the registry; probe, reverse engineer, or attack the Service or its infrastructure; circumvent rate limits, authentication, or review; use automated clients other than the official app except as we have agreed in writing; or resell or commercialise access to the Service.
We apply rate limits to the API. Persistent attempts to exceed them may result in blocking or termination.
09Availability and changes
The Service is provided without any uptime commitment. We may change, suspend, or discontinue features, and may impose or vary limits, at any time. We will give reasonable notice of material changes where we can.
Because the Service is free, we may also discontinue it entirely. If we do, we will give notice and a period to export or delete your data.
10Your rights under the Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. If any part of these Terms would do so, that part does not apply to you.
Where our services come with guarantees that cannot be excluded under the Australian Consumer Law, and we fail to meet one of them, you are entitled to have the service supplied again or to a refund of the price paid. Because KimeGem is supplied free of charge, no price has been paid, so the practical remedy is re-supply.
The two sections that follow are read subject to this one. They limit what we are responsible for only to the extent the law allows us to.
11Disclaimer of warranties
Subject to the Australian Consumer Law section above, and to the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that conflicts will be detected, that alerts will be delivered, or that any verification result is accurate.
12Limitation of liability
Subject to the Australian Consumer Law section above, and to the maximum extent permitted by law, Kimevik is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for lost profits, lost sales, loss of a diamond, loss of value, loss of data, or reputational harm, arising out of or connected with the Service — whether or not we were advised such loss was possible.
In particular, and without limiting the above, we are not liable for any loss arising from a purchase or sale you made or did not make, from a conflict we did or did not detect, from a verification result, from an alert that was delayed or not delivered, or from the acts of any other user.
Where liability can lawfully be limited but not excluded, our total aggregate liability for all claims is limited to AUD 100.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded under applicable law.
13Indemnity
You agree to indemnify and hold Kimevik harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from content you submitted, your breach of these Terms, or your misuse of the Service — including any claim brought by another user or by a third party about a stone, a sale, or a conflict.
14Suspension and termination
You may stop using the Service at any time and mark your account for deletion in Settings. We may suspend or terminate an account that breaches these Terms, that appears to be operating fraudulently, or where required by law. Where the circumstances allow, we will explain why.
The sections on your content, disclaimers, limitation of liability, indemnity, and governing law survive termination.
15Intellectual property
The KimeGem and Kimevik names, marks, software, design, and content belong to us or our licensors. These Terms grant you a personal, revocable, non-transferable licence to use the app and website for their intended purpose, and nothing more.
GIA, IGI, GCAL, and GSI are the marks of their respective owners. KimeGem is not affiliated with, endorsed by, or authorised by any grading laboratory, and references to them are descriptive only.
16Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. You and Kimevik submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them. Nothing here affects rights you have under the law of the place you live, including the Australian Consumer Law.
Before starting formal proceedings, please write to support-kimegem@kimevik.com so we can try to resolve the matter directly. If we cannot, and your complaint concerns how we handled your personal information, you can also complain to the Office of the Australian Information Commissioner (OAIC).
17General
If any provision is found unenforceable, the rest continues in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them as part of a reorganisation or sale of the business.
These Terms and the Privacy Policy are the entire agreement between us about the Service. We will post updates here and change the “last updated” date; continuing to use the Service after a material change means you accept it.
